TERMS AND CONDITIONS OF THE LUKASZURBANIAK.COM.PL ONLINE STORE
§ 1. GENERAL PROVISIONS
The online store operating at lukaszurbaniak.com.pl is run by:
ŁUKASZ URBANIAK STUDIUM MUZYCZNEJ KREATYWNOŚCI ” A VISTA” with its registered office at ul. Mławska 5A, 85-441 Bydgoszcz, Poland, Tax ID (NIP): 5542483569, Business Registry No. (REGON): 340919091.
These Terms and Conditions set out the rules for using the Store, placing orders, and purchasing Digital Content (sheet music in PDF format).
To make a purchase in the Store, you need a device with Internet access, a web browser, an active e-mail account, and software capable of opening PDF files (e.g. Adobe Acrobat Reader).
§ 2. PLACING ORDERS AND PAYMENT
The subject of sale is digital sheet music material in PDF format (Digital Content).
Prices given in the Store are gross prices (they include tax).
The Buyer places an order by adding the selected piece to the cart, completing the order form (first name, last name, e-mail), and making payment through the available electronic payment gateways.
The sales contract is concluded at the moment the Buyer successfully completes payment.
§ 3. DELIVERY OF DIGITAL PRODUCTS
Digital products (PDF files) are delivered electronically.
Once payment is confirmed, the system automatically sends an e-mail to the address provided by the Buyer, containing a link to download the purchased PDF file or the file as an attachment.
The file is delivered promptly after payment is confirmed, no later than within 24 hours.
§ 4. RIGHT OF WITHDRAWAL (COMPLAINTS AND REFUNDS)
Exclusion of the right of withdrawal: Pursuant to Article 38(13) of the Polish Consumer Rights Act (Ustawa o prawach konsumenta), the right to withdraw from a distance contract does not apply to a consumer in respect of contracts for the supply of digital content not delivered on a tangible medium, where performance began with the consumer’s express prior consent before the withdrawal period elapsed, and after the consumer was informed that they would thereby lose the right of withdrawal.
By consenting to download the PDF file before the 14-day period has elapsed, the Buyer loses the right to a refund (withdrawal from the contract).
If technical defects in the file are found (e.g. a corrupted file, inability to open it, incomplete content), the Buyer has the right to file a complaint by e-mail to the Administrator.
Complaints are processed within 14 days of the date they are submitted. If a complaint is justified, the Administrator will send a corrected file or issue a refund.
§ 5. COPYRIGHT AND LICENCE
All digital products (PDF sheet music) available in the Store are original works created by Łukasz Urbaniak and are protected under the Polish Act of 4 February 1994 on Copyright and Related Rights.
Purchasing the sheet music grants the Buyer a non-exclusive, non-transferable licence to use the work solely for personal use and for educational/performance purposes (e.g. preparing and performing the piece with the Buyer’s choir/ensemble, unless the product description states otherwise).
It is prohibited to:
Resell, share free of charge, or distribute the purchased PDF files on the Internet.
Copy and share the files with third parties beyond the scope of the granted licence.
Modify the content of the sheet music without the Authors’ consent.
§ 6. FINAL PROVISIONS
These Terms and Conditions apply from the date of publication on the lukaszurbaniak.com.pl website.
In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, including the Civil Code and the Consumer Rights Act.
